PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS AT THE COURTHOUSE IN SUNDANCE, CROOK COUNTY, WYOMING

8:30 o’clock a.m. Present were Chairman Fred M. Devish, Vice-Chairman Kelly B. Dennis, Member Bob Latham and County Clerk Melissa Jones.

Petition for Formation of Beulah I&S District

The County Clerk presented and filed with the Board a Certificate of Petition for the Formation of Beulah Improvement & Service District. Presenting that, on October 2, 2023, a “Petition to Form Beulah Improvement and Service District” was received in the County Clerk’s Office. The Department of Revenue & Crook County Assessor reviewed the petition and verified the boundaries of the proposed district. Based off the landowner information received from the County Assessor, the County Clerk reviewed the Petition and verified that it was signed by at least sixty percent (60%) of the landowners owning at least sixty percent (60%) of the assessed property for the proposed district. The petition was signed by 32 of the 38 parcel owners which calculates to 84%. The assessed valuation of the 38 parcels is $12,622,154.00, the assessed valuation of the 32 signors is $11,795,388.00 which calculates to 93%. The Petition was accepted for filing with the County Clerk’s Office on November 27, 2023.

In accordance with W.S. 22-29-109 at this time a hearing date has been set for February 7, 2024, at 2:00 o’clock p.m.

After discussion, Kelly moved to appoint Gary Anderson on behalf of HDR Engineering, Inc., as the Crook County Contract Engineer and Surveyor. Bob seconded, all ayes, motion carried.

RESOLUTION NO. 2023-20

A RESOLUTION ESTABLISHING USUAL BUSINESS HOURS

WHEREAS, per Wyoming Statute 18-3-103(b), county officers shall keep their offices open during the usual business hours of each day excluding Saturday, Sunday, legal holidays and other days established by the County Commissioners in the Crook County Handbook, Section VII and Section XII.

THEREFOR BE IT RESOLVED by the Board of County Commissioners in and for Crook County, Wyoming that the offices in the courthouse shall remain and be open from 8:00 A.M. to 5:00 P.M Monday through Friday of each week, except:

1. The offices in the courthouse shall be closed on the following legal holidays and other days:

Dan Thomas, County Assessor, Tammy Jundt, County Treasurer, Joe Baron, County Attorney, Jeff Hodge, County Sheriff and Julie Crawford, Clerk of District Court were present to go over items of interest within their departments.

Dan Thomas, County Assessor: Last month in attendance for the compensation committee presentation meeting, a few meetings with the Wyoming County Assessor’s Association’s Executive committee, as well as the department head meeting. I presented to the 7th graders the exciting world of the Assessor’s Office. Mostly we discussed how revenue is generated from property in Wyoming and utilized our County aerial photos to view most of their homes. I received the numbers from the Department of Revenue that include the estimation of lost revenue from ‘The People’s Initiative to Limit Property Tax’. In the first year we would lose $287,910, the schools would lose over $741,000 all other entities would lose a total of $543,268 of property tax revenue. We finished up getting all our personal property declarations ready to ship out. We processed 33 deeds of transfer of ownership last month.

Joe Baron, County Attorney: New Cases: 32 Closed Cases: 46 Current Case Load: 67 In Court: 63 times Juvenile/Diversion Cases: 39 Civil work: Advise various law enforcement agencies. Reviewed IT Contract with KLH, awaiting their response. Advised County Officers and Department Heads. Worked with Planning Department on the enforcement of Subdivision Rules, planning contract and subdivision applications. Prepared documents for the Reed Public Road Alteration. Reviewed the Inyan Kara Bridge right of way and BROS application. Discussed changes made to the FRTA Easements with the Forest Service Attorney and awaiting their further response. Revised Title 25 forms and contacts. Started to review the Form 8 landowner authorization for inclusion to the proposed Kendrick Expansion to the Strata Uranium Mine near Oshoto. Review of Beulah Improvement and Service District Application. Review of contract between Sheriff and Weston County Joint Powers Board.

Melissa Jones, County Clerk: 307 titles made, 460 documents recorded, attended the Coalition Meeting, working with Katie on updating DFC Grant key personnel, presented for the 7th grade on Civics Day, worked on the salary matrix with Alex, attended the Compensation Committee meeting, worked on paperwork for proposed Special District, Certified our BOE files to the State BOE

Julie Crawford, Clerk of District Court: Total Receipts: $8,949.93 with $4,362.68 to the County 10 new case filings 40 record searches 2 new passports and assisted 3 customers with renewal passports 2 civil appeals in process I attended a Teams Meeting with the Supreme Court regarding updates to FCE and the upcoming rollout of E-Filing for Crook County. I also attended a Child Support Authority special board meeting via Teams, an Employee Compensation Committee Meeting and I attended the Department Heads Meeting. I also participated in the county wide 7th grade civics classes’ visit to the courthouse which included me giving them a tour of the courtroom while explaining the different positions within the court system and how jury duty works. We participated in the courthouse’s first annual decorate your office door competition and being up against a lot of very talented competitors, we brought home the coveted snowmobile trophy for the coolest office in the courthouse.

Jeff Hodge, County Sheriff: work on fire radios, Charlie got parts off old patrol vehicle so it is ready for auction, fully staffed now, headed next week to the Sheriff Association meetings, went to Newcastle to do CERT trainings, working on hooking Weston County to our Flex System, discussed safety at Sundance pond, tracking legislation.

Tammy Jundt, County Treasurer: Total receipts were $5,740,100.97 and disbursements to the county, county boards, towns and schools were $2,842,338.87. In November we did 4,223 transactions. We were very busy at the counter and received many property tax payments in the mail. As our deadline for the 1st half payment property tax was November 10th. We had 7th graders come tour our office. Attended the Employee Compensation Committee and Dept Head meeting. I have four warrants this year that on the first Monday in December was over a year old. I have cancelled them as per statute 18-4-106.

County Commissioners: Bob: Attended the Fair Board meeting, took calls on roads. Fred: took calls on roads, traveled roads. Kelly: attended various county board/district meetings, traveled the New Haven & Bertha roads to inspect them.

Roger Connett, RER, was present to give an update on items of interest.

Morgan Ellsbury, Road & Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor gave monthly reports.

Joe Baron, County Attorney discussed a Petition to Alter a Portion of Public Road No. 282 known as Reed Road. Joe recommended appointing Morgan Ellsbury to be a viewer. Kelly moved to approve the Agreement to Cover the Costs of Altering a Portion of Public Road No. 282 Known as the Reed Road and to appoint Morgan Ellsbury as viewer. Bob seconded, all ayes, motion carried.

Kelly moved to approve a Final Acceptance Certificate for the FY23 CMAQ grant. Bob seconded, all ayes, motion carried.

Kelly moved to approve a FY 2024 Congestion Mitigation Air Quality Program Subrecipient Agreement Between The Wyoming Department of Transportation and Crook County. Bob seconded, all ayes, motion carried.

Joe Baron & Morgan Ellsbury discussed the Cooperative Forest Road Agreement. Joe and Morgan will meet with the Forest Service Grants Management Specialist to go over the details of the agreement prior to the Board signing.

Sara Fleenor, UW Area Educator, Jasmyne Bryant, Events Coordinator, Fair/Facilities, Bonnie Stahla, Director, Crook County Library and Carol Stutzman, Public Health Nurse gave monthly reports.

Kelly moved for the Chairman to sign a letter to Wyoming Retirement informing them that there are no longer fair employees, those employees are now employees of the county. Bob seconded, all ayes, motion carried.

Tim Lyons, Planning Director, and Caleb Peters, Wastewater Specialist, gave a monthly report.

Bob moved for the chairman to sign a Contract with Independent Contractor for Services and or Material Addendum 1 with Jayna Watson, AICP. Kelly seconded, all ayes, motion carried.

Present for the proposed Amended Crook County Minor Subdivision Regulations and Crook County Land Use Planning & Zoning Commission Amended By-Laws hearing were Mark Erickson, Gregory Henderson, Mark & Wendy Neugebauer, LaVonne Rutherford, Caleb Peters, Tim Lyons and Joe Baron.

Tim Lyons presented on the proposed amendments to the Crook County Land Use Planning & Zoning Commission By-Laws. LaVonne Rutherford addressed the Board. Bob moved to approve all amendments, except to leave the word morals. Kelly seconded, all ayes, motion carried.

Tim Lyons presented on the proposed amendments to the Crook County Minor Subdivision Regulations. Wendy Neugebauer, Gregory Henderson & Mark Erickson addressed the Board. Discussion was held on amending #22 on page 11 to include the word “may” and on lot, road & cul-de-sac size decreases in the amendments. Bob moved to approve all amendments, except the changes to road & cul-de-sac size requirements. Kelly seconded, all ayes, motion carried.

Marc Brown, Ryan Scott, Kaitlyn Bennett & Shawn Waldron, HBW Resources, were present via Teams, to go over the County-by-County Energy Assessment. Also, present were Jeanne Whalen, Morgan Ellsbury, Caleb Peters, Tim Lyons and Joe Baron.

Jeanne Whalen, Whalen Consult, LLC and via Teams Dru Bower, DRU Consulting, LLC gave monthly reports.

Jeanne and Dru discussed that the Black Hills National Forest Land Management Plan assessments are available online. Bob moved to amend his motion on the Crook County Minor Subdivision Regulations to approve all amendments, except the changes to road & cul-de-sac size requirements and to add “may” in point 22 on page 11. Kelly seconded, all ayes, motion carried.

Josh Jundt, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

A discussion was held on the BROS bridge project on County Road No. 93. Morgan stated the bridge is to remain where currently located. Joe and Morgan will work with the landowner to obtain an easement for such.

Bob moved to approve the Final Reconnaissance Report for Project CN18065 Crook County Road No. 112 Bridge of Donkey Creek. Kelly seconded, all ayes, motion carried.

Dan Thomas, County Assessor, presented the following tax roll correction: O0012536. Kelly moved to approve the corrections as presented. Bob seconded, all ayes, motion carried.

Morgan Ellsbury, Road & Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor continued their monthly reports.

After discussion, Bob moved to approve the following resolution:

RESOLUTION NO. 2023-21

TO COMMENCE PROCEEDINGS TO ALTER A PORTION OF PUBLIC ROAD NO. 282, KNOWN AS THE REED ROAD

WHEREAS a Petition was filed by Cathyrn A. Glacken with the Board of County Commissioners to alter a portion of a public road No. 282, known as the Reed Road, located upon the following described property, and more particularly described on the map attached to the Petition, to-wit:

T.50N., R.62W. OF THE 6TH PRINCIPAL MERIDIAN, CROOK COUNTY, WYOMING

SECTION 15 : SW1/4NE1/4; NW1/4SE1/4;

And the Reed Subdivision recorded at Instrument No. 585590 located at File 452 Map 1414

WHEREAS an agreement was entered into with Cathyrn A. Glacken to pay for the costs to commence proceedings to determine whether to alter a portion of said public road that are set forth in the Reed Subdivision; and

WHEREAS James A Tagart, Jennifer J. Adams, Jeff Mickle, Ann Marie Mickle, Cathyrn A Glacken, Trustee of the Cathyrn A. Glacken Rev. Living Trust u/t/d May 15, 2020, Leonard B. Reynolds, Margaret E. Reynolds, Jeremy Dedic and Juan Flores, Co Personal Representatives of the Estate of William A. Teaney, the landowners affected by the alteration across their property have consented to the alteration; and

WHEREAS Wyoming Statute 24-3-101 et seq., allows any public road to be altered by statute and vacated in a manner provided by caselaw; and

WHEREAS a viewer was appointed pursuant to Wyoming Statute 24-3-105 and 106 who filed a written report with the Board of County Commissioners recommending the proposed route be altered as petitioned; and

THEREFORE, BE IT RESOLVED that proceedings be commenced to determine whether or not to alter a portion of the public road No. 282, known as the Reed Road, set forth above pursuant to Wyoming Statute 24-3-101, et seq.

Kenny Byrne was present to discuss the War Memorial/War Memorial Committee. Also, present were Jill Macky, Larry Schommer and Joe Baron. Discussion was held on the selection criteria as well as adding pavers to the memorial area to honor those who live in Crook County, but do not meet the current criteria. The Board requested that the committee update the selection criteria and bring that information back to the Board.

Ed Robinson, Homeland Security County Coordinator and Charlie Harrison, Fire Warden gave monthly reports.

1:00 o’clock p.m. Present were Chairman Fred M. Devish, Vice-Chairman Kelly B. Dennis, Member Bob Latham and County Clerk Melissa Jones.

Bridget Helms, Office Manager and Jessica Halverson, Conservation Resource Coordinator, CCNRD and Tim Veldor, Marketing Communications Specialist, PRECorp, gave updates on items of interest within their entities.

Present for the monthly IT update from KLH were Tom Overstreet, via Teams, Joe Baron, Julie Crawford, Dan Thomas, Tim Lyons and Ralph Knode.

Bob moved to sign a Contract with Independent Contractors for Consulting Services on Software Programs, Hardware Installation for Computers and Internet Services with KLH. Kelly seconded, all ayes, motion carried.

Ralph Knode, CEO Strata, was present to give an update on items of interest. Discussion was held on an Authorization for Inclusion of Crook County Roadways in the Proposed Kendrick Expansion of the ROSS ISR project. Joe Baron recommended the board give Morgan time to review the authorization prior to their approval.

Bob moved to sign a letter to the municipalities requesting their appointment to the Solid Waste District Joint Powers Board. Kelly seconded, all ayes, motion carried.
