Jeanne moved to transfer funds as follows: Pursuant to Wyoming Statute 16-4-112, notice is given that a Resolution

has been proposed to transfer $30,000.00 from Unanticipated Revenues to the County Sheriff E911 Call Works budget 100.05.00087.00. Notice is further given that a hearing of the Board of Crook County Commissioners of Crook County, Wyoming will be held on December 6, 2022, at 8:30 o’clock a.m. to consider such proposed resolution. Fred seconded, all ayes, motion carried.

Jeanne moved to approve the minutes from October 4 & 5, 2022. Fred seconded, all ayes, motion carried.

Fred moved to approve the following resolution:

RESOLUTION NO. 2022-24

FISCAL YEAR 2023 BUDGET AMENDMENT

WHEREAS Crook County adopted the Fiscal Year 2023 Budget in accordance with the Wyoming Uniform Fiscal Procedures Act; and

WHEREAS the Board of Crook County Commissioners wishes to amend the adopted budget in accordance with the same Act; and

WHEREAS, no protests were received regarding such transfer.

NOW, THEREFORE, BE IT RESOLVED that the following budget amendment is made.

• $12,510.90 to the Fire Budget New Equipment Line-from Unanticipated Revenues due sale of a county dozer.

Tammy Jundt, County Treasurer: Total receipts were $5,402,143.76 and disbursements to the county, county boards, towns and schools were $2,058,412.19. In October we did 3,480 transactions. We have been busy at the counter and have been receiving a lot of property tax payments in the mail. Visited with Joe on BW Oil/Black Thunder Oil on trying to collect delinquent taxes. I also have been working with Joe on the civil fee dispute. I have discovered that on July 1, 2016, the statute pertaining to civil fees for sales tax was changed and our computer program was not updated. This has been a big project. WYDOT has sent us a sample of the new plates that will come out in 2025. They are a picture of the state flag.

Theresa Curren, County Assessor: Field crew is out in the county picking up new construction so it can be entered for the 2023 tax roll.  If the public has built anything new, now is the time to notify our office.  We have put a help wanted advertisement in the paper and on the website along with Wyoming at Work for a field appraiser.  We only had 51 deeds for October.

Jeff Hodge, County Sheriff: continued working on the E911 system, lost a detention officer, but have another hired, setting up to have a leadership training in January and invited all departments to send attendees, still working on the tower and repeaters.

Melissa Jones, County Clerk: 280 titles made, 589 documents recorded, applied for the next round of ARPA funding, held the public test on election day equipment, got all machines, ballots & supplies bags ready for the polls, published all statutorily required notices, worked on the telephone system with Joe and Chris, reviewed and denied a special district petition, attended the salary committee meeting, got the webpage up and going for that committee with the help of Raquel and worked on the salary matrix.

Tina Wood, Clerk of District Court: Julie and I both attended trainings on a new computer system that will go into effect next week, our current system is done as of the end of October, attended the department head meeting.

Joe Baron, County Attorney: Joe Baron: New Cases: 18 Closed Cases: 24 Current Case Load: 59 In Court: 23 times John Starcevich: New Cases: 12 Closed Cases: 23 Current Case Load: 34 In Court: 21 times We also have 26 cases involving minors in Juvenile Court or Diversion. John will be leaving on November 4 due in part to a lack of affordable housing. I am advertising for another Deputy County Attorney. Reviewed three officer involved shooting investigations. Concluded the officer’s actions were justified. Attorneys also dealt with civil matters for the county officials. Joe reviewed and prepared documents on roads 21, 807 and 160; prepared forms with the Planning Department for the Large Acreage Subdivision regulations, prepared the MOU’s with the Forest Service for the revision of the Forest Plan, assisted the Treasurer on a tax collection issue; assisted the County Clerk with review of the rejection of the Yellowstone Ranch Improvement and Service District petition and reviewed and rejected enlargement of the Tower Ridge Estates Improvement and Service District as the documentation contains errors. Assisted, reviewed and approved as to form Homeland Security Grants for the Code Red system and some radios for $14,061.60 and $18,367.00, totaling $32,428.60. Received and rejected Title 25 Claims submitted to the county. Non-resident billing totaling $16,932.67 which will be reduced to the Medicaid rate and paid by the Wyoming State Hospital; and Balance Billing $3,545.55, totaling a savings to the count of $20,478.22. Balance Billing is billing the county after insurance pays. Since the county and state are payors of last resort neither will pay the remainder of the bill if the Involuntarily Hospitalized patient’s private or public insurance pays more than we would have paid. Law enforcement officers now gather insurance and residency information which saved the county $20,478.22 this past month. Assisted Clerk with the telephone billing.

County Commissioners: Jeanne: attended the NEWY Outdoor Recreation Collaborative meeting, met with Celerity on broadband, attended the Forest Plan Revisions meeting. Fred: good conversations with citizens on property taxes, positive conversations on roads, spoke with Moorcroft Mayor about EMS and participated in the interview process in Sundance with the company auditing EMS. Kelly: routine business, lots of phone calls, some of which were questions about the Large Tract regulations.

Preston Beckstead, Resident Engineer, Wyoming Department of Transportation (WYDOT), gave an update on bridge and road projects.

Dru Palmer, Dru Consulting, LLC gave a monthly report.

Jeanne moved to authorize Dru to hire Falon Law office to write a Memo on the Options for 2012 Planning Rule. Fred seconded, all ayes, motion carried.

Morgan Ellsbury, Road & Bridge Superintendent and Larry Schommer, Facilities Maintenance Supervisor continued their monthly reports.

Ed Robinson, Homeland Security County Coordinator and Doug Leis, Fire Warden gave monthly reports.

Present for the monthly IT update from KLH were Tom Overstreet, via Teams, Morgan Ellsbury, Tina Wood and Bob Latham.

RESOLUTION NO. 2022-25

ORDER VACATING A PORTION OF COUNTY ROAD NO. 21, KNOWN AS THE COLD SPRINGS ROAD, AND VACATING A PORTION OF COUNTY ROAD NO. 807 KNOWN AS THE LOST CANYON COUNTY ROAD

WHEREAS a Petition was filed by Moskee Land Corp., LLC with the Board of County Commissioners to vacate portions of the Cold Springs County Road No. 21 and portions of the Lost Canyon County Road No. 807;

WHEREAS W.S. 24-3-101, et sec., allows for the establishment, alteration, and/or vacation of County roads;

WHEREAS a Viewer was appointed in accordance with W.S. 24-3-103 through 105 who provided a report to the County Commissioners which was advertised on June 9, 2022 in the Sundance Times, Moorcroft Leader and Wyoming Pioneer and on the County Website for a hearing to consider the Viewers Report on June 14, 2022 and also published on the county website at Public Notices at http://www.crookcounty.wy.gov; and at said hearing the Board voted to commence said proceedings based upon the viewers report set forth in Commissioners Proceedings Book 12 Page 282;

WHEREAS on July 6, 2022, the Board of County Commissioners adopted Resolution 2022-19 To Commence Proceedings to vacate portions of the Cold Springs County Road No. 21 and portions of the Lost Canyon County Road No. 807 adopted on July 6, 2022, and the County Clerk mailed it to various parties having an interest in the proceedings;

WHEREAS the list of “parties” having an interest in the land over which the road was proposed to be vacated that are required to be sent notice of the possible vacation of the roads in this matter by certified mail as required by W.S. 24-3-110 were obtained from a review of the records search obtained from First American Title Company, the County Assessor, the County Clerk’s Office;

WHEREAS on August 23, 2022, the County Clerk mailed copies of the Notice of Hearing to Vacate portions of the Cold Springs County Road No. 21 and portions of the Lost Canyon County Road No. 807, by U.S. Mail, certified, return receipt requested to all parties having an interest in the land over which the road is proposed to be vacated as required by W.S. 24-3-110;

WHEREAS the Notice of Hearing to Vacate portions of the Cold Springs County Road No. 21 and portions of the Lost Canyon County Road No. 807 was published in the Sundance Times a newspaper of general circulation in Crook County, Wyoming, for two (2) consecutive weeks August 25, 2022 and September 1, 2022, and also published on the county website at Public Notices at http://www.crookcounty.wy.gov as required by W.S. 24-3-110;

WHEREAS written objections were filed with the County Clerk of Crook County on or before noon on October 3, 2022, so the hearing upon the written objections to Vacate portions of the Cold Springs County Road No. 21 and portions of the Lost Canyon County Road No. 807 was set for November 1, 2022, at 2:30 P.M. Notice of said hearing was mailed on October 6, 2022 to all written objectors and all petitioners;

WHEREAS there were no claims for damages filed by any objector in writing with the County Clerk of Crook County on or before noon on October 3, 2022, therefor any claim for damages shall be disregarded, and not considered, and shall be deemed to have been waived and forever barred pursuant to W.S. 24-3-113;

WHEREAS at the hearing on November 1, 2022, at 2:30 P.M the Board of County Commissioner’s considered the evidence and arguments presented from the petitioners and the objectors that filed written comments with the County Clerk in a timely manner and find that it is in the best interest of Crook County that the roads as set forth herein be vacated.

THEREFORE BE IT RESOLVED AND ORDERED by the Board of County Commissioners in and for Crook County, Wyoming that:

1. The portion of the Cold Springs County Road No. 21 is hereby VACATED as shown on the Map of Survey recorded at Instrument No. 623271 located at Rod 26 Map 1499 across the following described property, to wit

3. This Resolution shall be indexed and noted in the County Road Index and County Road Map Book, and the land records of the Crook County Clerk, Sundance, WY.

4. The County Clerk shall refund any unused funds deposited after all costs and expenses are paid concerning these proceedings.

The meeting adjourned at 2:33 o’clock p.m. to meet in special session on November 15, 2022, 9:00 o’clock a.m. and regular session on December 6 & 7, 2022 at 8:30 o’clock a.m., in the Commissioner’s Room at the Courthouse in Sundance, Wyoming.
